This website is operated by EL-TONIC Co. Pty Ltd, trading as EL-TONIC (“EL-TONIC”, “we”,“us” or “our”).
These Terms & Conditions apply when you use our website from us. By placing an order, you agreeto them. If you do not agree, do not use the website or place an order.
Orders & Payment
Prices are in Australian dollars (AUD) and include GST where applicable. Shipping and other charges are shown before checkout. We may change prices, but not for an accepted order unless correcting an obvious error.
Orders are subject to availability and our acceptance, which occurs when we send an order or dispatch confirmation. You authorise us and our payment provider to charge the checkout total. Before dispatch, we may reject or cancel an order for unavailability, an obvious pricing error, failed payment, or suspected fraud or illegality. If we cancel after payment, we will refund the original payment method. Your Australian Consumer Law rights are unaffected.
Products & Product Use
We take reasonable care with product descriptions, images and ingredient information, but coloursand results may vary with skin tone, application, lighting and screens. Packaging and ingredients may change, so check the product label before use. Australian Consumer Law guarantees about descriptions and samples still apply.
Please follow the directions, warnings and storage instructions, and check ingredients for allergies or sensitivities. Patch test before first use, especially on sensitive skin. Use products only as directed; stop if irritation occurs and seek medical advice if symptoms are serious or persist. Keep products away from children as directed.
EL-TONIC tanning products are cosmetics, not treatments for medical conditions, and do not provide sun protection. Use suitable sunscreen and follow sun-safety advice. Website information is general, not medical advice.
Shipping
Delivery times are estimates. We will use reasonable efforts to meet them and, where practicable, notify you of material delays. Australian Consumer Law rights and remedies are unaffected.
You must provide accurate delivery details and promptly report errors. We are not responsible for delay or non-delivery caused by incorrect details, except to the extent we contributed or the law requires otherwise. Title passes on full payment and risk on delivery, subject to applicable law.
Returns & Refunds
Except where law requires otherwise, we do not accept change-of-mind returns of opened, used or unsealed cosmetics that cannot be safely or hygienically resold. Any offered change-of-mind return is subject to the website conditions at purchase. Australian Consumer Law rights are unaffected.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. If goods are faulty, unsafe, damaged, incorrect, unacceptable or not as described, contact us with order details and reasonable evidence. Available remedies may include repair, replacement, refund and compensation. For a major failure, you may reject the goods for a refund or replacement, or keep them and claim reduced value. We cover reasonable return costs where law requires and will not require an unsafe or unreasonable return. We may request reasonable proof of purchase.
Intellectual Property
Website content, including EL-TONIC branding, images, videos, packaging, graphics and text, is owned by or licensed to EL-TONIC Co. Pty Ltd.
You may use website content personally and non-commercially. Except as law permits, do not copy, adapt, distribute, communicate or commercially exploit it without written permission. No intellectual property rights transfer to you.
Website Use
Do not misuse the website, gain unauthorised access, introduce malicious code, harvest data, disrupt operations, impersonate others, or act unlawfully, fraudulently or in breach of rights. We may reasonably restrict access to protect the website, users or our interests. Third parties control linked sites; we are not responsible for them except as law requires.
Liability
Nothing in these Terms excludes, restricts or modifies Australian Consumer Law guarantees or any other rights or remedies that cannot lawfully be excluded (Non-Excludable Rights). These Terms are subject to those rights.
Subject to Non-Excludable Rights and law, we are not liable to the extent loss is caused by product misuse, ignored directions or warnings, unauthorised alteration, or events beyond our reasonable control. We do not exclude liability that cannot lawfully be excluded. Where a statutory guarantee may lawfully be limited, our liability is limited, at our option, to repair, replacement, equivalent goods or their reasonable cost, unless that limit is not permitted, fair or reasonable.
Privacy
Your use of our website is also subject to our Privacy Policy, which explains how we collect and manage personal information.
Changes to These Terms
We may update these Terms by publishing a revised version. Changes apply from the stated date and do not alter an accepted order unless required by law or agreed with you. The current version ison our website.
Queensland law governs these Terms. You and EL-TONIC submit to the non-exclusive jurisdiction of Queensland courts and appeal courts, without limiting a consumer’s right to bring a claim elsewhere under applicable law.
